Registering inherited property into the heirs' names

When someone dies, their Italian property stays in their name until the succession is declared, the transfer transcribed at the land registry and the cadastral records updated. We handle all of it for you, for a fixed fee, without you leaving home.

You don’t have to become an expert in the Italian land registries overnight — that’s our job. Registering an inherited property into the heirs’ names is the step that finally puts the home in the family’s name, so it can be kept, transferred or sold.

If you need the whole estate dealt with — the heirs proved, the tax, the bank accounts as well as the property — that is our succession administration service, and the registration is included in that fixed fee.

What we do

Italian title moves in two registers: the property is transcribed to the heirs at the land registry, and the cadastral records are updated (the voltura catastale — nowadays usually requested within the telematic succession return itself). Where a foreign will governs, it must first be deposited and published before an Italian notary (the pubblicazione). We handle the whole sequence, with all the supporting documentation and official procedures, and the records confirmed right once the transfer is complete.

  • We check the existing land-registry and cadastral records for the property, and flag anything — an old discrepancy, an unregistered change — that would hold the transfer up.
  • We arrange the publication of the will where one governs, prove the heirs, and obtain a codice fiscale for each heir by proxy.
  • We file the succession return (dichiarazione di successione) with the cadastral-transfer request, and deal with the cadastral and mortgage taxes the transfer requires (2% + 1% of the cadastral value, paid by you directly).
  • We see the transcription and the voltura through to records confirmed in the heirs’ names.

We act for you under a power of attorney with special powers, so you never need to travel to Italy, and everything is handled in plain English.

When it's included, and when it's a service on its own

When we settle the whole Italian estate for you, transcribing the property and updating the cadastre is part of that fixed fee — there is no separate charge.

This page is for the times you need the registration on its own: an Italian property your home-country lawyer is administering as part of an estate abroad, an additional Italian property, or a title that was simply never moved into the heirs’ names after an earlier death.

A typical situation

David’s father had died some years ago, and the family had dealt with the English estate at the time — but the small apartment near Imperia was never put into the children’s names, and now they wanted to sell it. There was nothing else left to do in Italy; they just needed the records moved across. We obtained the missing documents, made the late succession filing, and saw the transcription and voltura through into the three children’s names — ready to sell — without any of them travelling.

Our fee

A fixed fee, agreed in writing before we start, with third-party costs (the taxes, stamps and any notarial act) shown separately — never folded into our fee.

  • Included when we are settling the estate for you — the transcription and voltura are part of that fixed fee, with no separate charge.
  • €1,500 + VAT as a standalone instruction — where the estate is being handled elsewhere, there is an additional property, or a title was never moved after an earlier death.

VAT is charged at the Italian rate (currently 22%) and always shown separately, so our fee is clear.

How long it takes

The voltura is nowadays usually processed together with the telematic succession return; the land-registry transcription follows once the filing and any notarial step are in place. From a complete file, allow a few weeks to a few months — longer where an old filing has to be made good first. We coordinate every step and keep you updated.
